Liability Waiver & Release

Assumption of Risk

I understand and acknowledge that participation in dance classes, private lessons, choreography sessions, camps, clinics, rehearsals, and any related activities offered by Elements Dance Company involves physical activity and inherent risks. These risks may include, but are not limited to, muscle strains, sprains, falls, collisions, overuse injuries, or other physical injuries.

I voluntarily choose to participate (or allow my child to participate) and fully assume all risks associated with these activities, whether known or unknown, foreseeable or unforeseeable.

Release of Liability

To the fullest extent permitted by Virginia law, I hereby release, waive, and discharge Elements Dance Company, its owner(s), instructors, coaches, contractors, employees, volunteers, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to participation in any Elements Dance Company activities, including those resulting from ordinary negligence.

This release does not apply to acts of gross negligence or willful misconduct.

Indemnification

I agree to indemnify and hold harmless Elements Dance Company from any loss, liability, damage, or cost, including reasonable attorney’s fees, that may arise out of participation or any breach of this agreement.

Medical Representation & Emergency Care

I certify that the participant is physically able to participate in dance activities and has no medical condition that would prevent safe participation. I understand that Elements Dance Company does not provide medical insurance coverage.

In the event of an injury or medical emergency, I authorize Elements Dance Company to seek medical treatment as deemed necessary. I agree to be financially responsible for any medical expenses incurred.

Photo & Video Release

I grant permission for Elements Dance Company to photograph or video the participant during classes, rehearsals, performances, camps, or events. I authorize the use of such photos or videos for promotional, educational, and marketing purposes, including on social media and the Elements Dance Company website, without compensation.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

Acknowledgment & Consent

I acknowledge that I have read and fully understand this waiver and release. I understand that by signing below, I am giving up certain legal rights on behalf of myself and/or my minor child. I sign this agreement freely and voluntarily.
